An area of law that is most often misunderstood is Estate Planning.

Let us examine (1) what is estate planning? (2) what is involved in estate planning? (3) who needs estate planning? and (4) what is included in my estate?

Most people think estate planning is only for the wealthy, the rich. But I am here to tell you that it is not. I have seen needless suffering and families painfully having to sell their home due to lack of planning. If you have possessions that have significant value to you or to those you love, such as a home, specific memorabilia, family photos, or special items you, your parents or grandparents brought with them when they immigrated, estate planning is for you.

Estate planning is the answer if you want to ensure that your assets are distributed as you would like them to be when you die and much more. Estate planning is a process. When done successfully, it transfers your assets to your beneficiaries quickly and with minimal tax consequences. Proper estate planning will also inform your family members how you would like your financial and medical affairs to be handled if you were to become incapacitated and/or not capable of making decisions for your family and yourself.

The process of estate planning involves people – your family and other individuals. It involves inventorying your assets and all the various forms of ownership and title that those assets may take. It involves talking over important decisions with family members and/or trusted friends and individuals. It involves discussing how your assets will be managed for your benefit if you are unable to do so and when and how certain assets will be transferred to family members and others either during your lifetime, at your death, or sometime after your death, and to whom those assets will pass. It involves making a Will and/or a Trust. You may, as most people, believe that estate planning is simply the writing of a Will. But it is much more.

Good estate planning will address the planning for your own personal and health care needs when you are no longer able to care for yourself. No estate planning is complete without a discussion about how health care decisions will be made if you become incapacitated. Obviously this is important to the very ill or elderly, yet it should be remembered – some of the most famous cases regarding the quality of life decision “pulling the plug” involved a 25 year old (Nancy Cruzan - Cruzan v. Missouri Dept of Health (1990) 497 U.S. 261) and 26 year old (Teri Schiavo) at the time of their accidents. Thus the Advance Health Care Directive (AHCD), Durable Power of Attorney for Health Care may well be one of the most important documents you will ever sign.

A Will is only one part of the estate planning process. Other documents may be needed to fully address your estate planning needs. Documents such as Advance Health Care Directive and Durable Power of Attorney for Financial Management (DPAFM) are powerful tools to address your welfare and needs and those of your family.

In starting to consider your estate planning needs, a good first step is to begin with a full, or as complete as possible, inventory of everything you own. You should ask yourself:

What are my assets and what is their value?

Prayer from Rev. Ranaud Guillaume:

“Bless the Lord o my soul, And all that is within me Bless His Holy Name.” (Psalm 103:1)

In the Name of the Father, and of the Son, and of the Holy Ghost: Father God, we humbly come to Thee to worship Thee and to glorify thy Name. We thank Thee for Jesus Christ our Lord and our Savior and the Holy Spirit our Comforter. We come before thy throne of grace to present ourselves as thy children and ask Thee to bestow upon us thy blessings. Please Lord accept this new service that we are about to offer to our community for thy glory. We dedicate this Website and all its contents to Thee. Help us and protect us in our endeavor from all negative attempts to disrupt us from our willingness to serve and help our fellow-countrymen. Give ear to our prayer, o Lord, and hide not Thyself from our supplication, we pray Thee in the Mighty Name of Jesus Christ. Amen.
